1. Introduction

These Terms and Conditions of Use (hereinafter "Terms") govern the use of the You book Me platform, an AI assistant service for booking and sales management (hereinafter "the Service").

The Service is operated by You book Me, a company incorporated under Belgian law, with its registered office in Belgium (hereinafter "we", "our" or "the Publisher").

By accessing or using the Service, you agree to be bound by these Terms. If you do not accept these terms, you must not use the Service.

2. Definitions

For the purposes of these Terms, the following terms have the following meanings:

  • "User": any natural or legal person using the Service.
  • "Customer": the User who subscribes to a paid subscription to the Service.
  • "Account": the personal space created by the User to access the Service.
  • "Content": all information, texts, images, data and other elements made available by the User or generated by the Service.
  • "Personal Data": any information relating to an identified or identifiable natural person.

3. Description of the Service

You book Me is an artificial intelligence platform that allows Users to:

  • Automate booking and appointment management
  • Interact with their customers via WhatsApp, Telegram and their website
  • Automatically qualify prospects and business opportunities
  • Manage multilingual conversations with their customers
  • Customize responses and behavior of the AI assistant

Specific features available may vary depending on the type of subscription.

4. Registration and User Account

4.1 Account creation

To use the Service, you must create an Account by providing accurate, complete and up-to-date information. You are responsible for the confidentiality of your login credentials.

4.2 Access conditions

Use of the Service is reserved for adults with the legal capacity to contract. If you are acting on behalf of a legal entity, you declare that you have the necessary authority to bind it.

4.3 Account security

You are fully responsible for all activities carried out from your Account. You agree to inform us immediately of any unauthorized use of your Account.

5. Use of the Service

5.1 Authorized use

You agree to use the Service in accordance with these Terms, applicable laws and regulations, as well as best practices in force.

5.2 Prohibited uses

It is strictly prohibited to use the Service to:

  • Disseminate illegal, defamatory, hateful content or content that infringes the rights of third parties
  • Disrupt the operation of the Service or attempt to gain unauthorized access to systems
  • Collect personal data from other users without their consent
  • Use the Service for spam or harassment purposes
  • Reproduce, copy, sell or commercially exploit the Service without authorization
  • Use robots, scrapers or other unauthorized automated means

5.3 Content responsibility

You are solely responsible for the Content you disseminate via the Service. You guarantee that you hold all necessary rights to this Content and that it does not infringe the rights of third parties.

6. Intellectual Property

6.1 Publisher's rights

The Service, including its structure, design, source code, texts, graphics, logos and features, is the exclusive property of the Publisher or its licensors. All intellectual property rights are reserved.

6.2 License to use

The Publisher grants you a limited, non-exclusive, non-transferable and revocable license to use the Service in accordance with these Terms. This license does not confer any property rights on the Service.

6.3 Your content

You retain ownership of the Content you create or upload via the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store and process your Content solely for the purpose of providing the Service.

7. Protection of Personal Data

The collection and processing of your Personal Data are carried out in compliance with the General Data Protection Regulation (GDPR) and applicable Belgian legislation.

7.1 Data collected

We collect data necessary for the operation of the Service, including: account information, booking data, conversation histories, Service usage data.

7.2 Your rights

In accordance with the GDPR, you have the right of access, rectification, erasure, restriction, portability and objection concerning your Personal Data. You can exercise these rights by contacting us via the contact details indicated in Article 13.

7.3 Data security

We implement appropriate technical and organizational measures to protect your Personal Data against loss, misuse, unauthorized access, disclosure, alteration or destruction.

8. Availability and Maintenance

We strive to keep the Service accessible 24/7. However, we do not guarantee that the Service will always be available, uninterrupted or error-free.

We reserve the right to temporarily interrupt the Service for maintenance, updates or in case of force majeure. We will endeavor to inform you in advance of any planned interruption.

9. Limitation of Liability

To the extent permitted by law:

  • The Service is provided "as is" and "as available"
  • We do not guarantee that the Service will meet your specific needs
  • We are not responsible for indirect, incidental or consequential damages
  • Our total liability is limited to the amount paid by you over the last 12 months

You are responsible for maintaining appropriate backups of your data. We strongly recommend that you regularly export your important data.

10. Pricing and Payments

10.1 Subscriptions

The Service may be offered free of charge during a trial period, then on the basis of paid subscriptions according to the rates in force published on our website.

10.2 Payment terms

Payments are made by credit card or any other means of payment offered. Subscriptions are automatically renewed unless you cancel before the renewal date.

10.3 Price modifications

We reserve the right to modify our prices at any time. New pricing conditions will be notified to you at least 30 days before they come into force.

10.4 Refund

In accordance with Belgian consumer law, you have a 14-day withdrawal period from the subscription. After this period, no refund will be granted except in case of manifest non-conformity of the Service.

11. Termination

11.1 Termination by User

You may terminate your Account at any time from your personal space or by contacting us. The termination will take effect at the end of the current subscription period.

11.2 Termination by Publisher

We reserve the right to suspend or terminate your access to the Service in case of:

  • Violation of these Terms
  • Non-payment of amounts due
  • Abusive or fraudulent behavior
  • Use of the Service in a manner detrimental to our interests or those of other users

11.3 Effects of termination

Upon termination of your Account, you lose access to the Service and all associated data. We recommend that you export your data before any termination.

12. Modifications to the Terms

We reserve the right to modify these Terms at any time. Significant modifications will be notified to you by email or via the Service at least 30 days before they come into force.

Your continued use of the Service after the modifications come into force constitutes acceptance of the new Terms. If you do not accept the modifications, you must stop using the Service and terminate your Account.

13. Applicable Law and Jurisdiction

These Terms are governed by Belgian law.

In the event of a dispute relating to the interpretation or execution of these Terms, we will endeavor to find an amicable solution. Failing that, any dispute will be submitted to the exclusive jurisdiction of the courts of Belgium.

14. General Provisions

14.1 Entire agreement

These Terms constitute the entire agreement between you and the Publisher regarding the use of the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the other provisions will remain in force to the fullest extent permitted by law.

14.3 Waiver

The Publisher's failure to exercise a right provided for in these Terms does not constitute a waiver of that right.

14.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time.
